These Terms of Service ("Terms") govern your access to and use of the services, software, websites, applications, mobile applications, and related products offered by Butter Software LLC ("Butter," "we," "us," or "our"). By accessing or using Butter’s services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
Butter provides scheduling, management, payment, communication, customer management, analytics, and operational software tools designed primarily for indoor golf facilities and related businesses. Certain functionality may rely on third-party providers and integrations.
You may use the Services only if you are at least eighteen (18) years old and have authority to enter into these Terms on behalf of yourself or the company or organization you represent. By using the Services, you represent and warrant that you satisfy these requirements.
You agree to provide accurate and complete information when creating and maintaining your account. You are responsible for safeguarding login credentials and are solely responsible for activities occurring under your account. You agree to promptly notify Butter of any unauthorized use of your account or suspected security incident.
Certain Services require payment of subscription fees or other charges. Pricing, billing frequency, payment terms, onboarding fees, implementation fees, and other charges may be outlined during signup, onboarding, within the platform, or in separate agreements. Payments may be processed through third-party providers including Stripe or other payment processors.
Unless otherwise specified in writing, fees paid to Butter are non-refundable. Failure to pay fees may result in suspension or termination of Services.
You authorize Butter and its payment providers to charge payment methods associated with your account for subscription fees, recurring charges, membership processing fees, payment-related fees, taxes, and any additional services selected by you.
Butter may modify pricing upon reasonable notice. Continued use of the Services following notice constitutes acceptance of updated pricing.
You retain ownership of information, customer records, business data, content, and materials submitted through the Services ("Customer Data"). You grant Butter a worldwide, non-exclusive license to host, process, transmit, display, store, and otherwise use Customer Data solely as reasonably necessary to provide, improve, secure, and support the Services.
Butter may generate aggregated, anonymized, and de-identified usage data that does not identify individual users or customers. Butter may use such aggregated data for analytics, benchmarking, product development, service improvement, and business purposes.
All software, technology, code, visual interfaces, branding, logos, trademarks, documentation, designs, content, and intellectual property rights associated with Butter remain the exclusive property of Butter Software LLC and its licensors.
You agree not to:
- use the Services in violation of any law or regulation
- reverse engineer, copy, modify, or create derivative works of the Services
- interfere with the operation or security of the Services
- distribute malicious code or harmful software
- transmit spam or unauthorized communications
- attempt unauthorized access to systems or data
- use the Services to infringe on rights of others
Butter may suspend or terminate access if we reasonably determine use violates these Terms or threatens Butter, users, systems, or third parties.
Both parties agree to maintain the confidentiality of non-public business, financial, technical, operational, and proprietary information disclosed in connection with the Services. Confidentiality obligations shall not apply to information that becomes publicly available through no fault of the receiving party, was independently developed, or must be disclosed by law.
Butter may provide SMS or MMS messaging related to account activity and service functionality. By providing your phone number and opting into text communications, you consent to receive text communications from Butter.
Program Description: Butter may send transactional and account-related messages including booking confirmations, onboarding instructions, account notifications, reminders, login verification codes, support communications, and security alerts.
Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message. After sending STOP, you may receive a confirmation message confirming your unsubscribe request. No additional messages will be sent unless you opt back in.

Message frequency may vary depending on account activity and use of the Services.
Message and data rates may apply according to your wireless carrier plan.
Wireless carriers are not liable for delayed or undelivered messages.
Butter relies on third-party providers and integrations, which may include payment processors, communication services, authentication providers, cloud hosting services, access-control systems, analytics providers, and APIs. Butter is not responsible for failures, interruptions, downtime, or issues caused by third-party services outside of Butter's reasonable control.
Butter may update, modify, discontinue, or replace portions of the Services at any time. We may also release new features, beta features, or experimental functionality.
Beta or early-access features are provided for evaluation purposes and may contain bugs, interruptions, or incomplete functionality.
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Butter disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, and uninterrupted availability.
To the maximum extent permitted by law, Butter shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, business interruption, loss of goodwill, lost data, or lost revenue.
Butter's total cumulative liability arising from or relating to the Services shall not exceed the total amount paid by you to Butter during the twelve (12) months preceding the event giving rise to liability.
You agree to defend, indemnify, and hold harmless Butter Software LLC and its officers, employees, contractors, affiliates, successors, and partners from claims, liabilities, losses, damages, and expenses arising out of your use of the Services, your Customer Data, or your violation of these Terms.
Butter handles information according to its Privacy Policy available at Butter Privacy Policy.
These Terms are governed by the laws of the State of Utah without regard to conflict of law principles. Any disputes arising from these Terms shall be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to the jurisdiction of those courts.
Butter may modify these Terms from time to time. Updated versions will be posted with a revised effective date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
